Retrospective Application

Originally, the Benami Act had limited retrospective effect. However, after the 2016 amendment, only procedural parts applied retrospectively, not penal provisions. This means transactions done before the amendment are examined, but penalties apply only to violations after 2016. This interpretation balances fairness while enabling action against past benami holdings without violating legal principles.
