Recalcitrant Account Holder
A recalcitrant account holder is an individual or entity that fails to provide the information FFIs need to determine U.S. tax status or refuses to consent to reportable data disclosure. Under FATCA, FFIs must withhold 30% on U.S.-source payments to and from these accounts, incentivizing full transparency and cooperation.
