Misrepresentation

Misrepresentation occurs when one party makes a false statement of fact that induces another party to enter into a contract. This false statement can be innocent, negligent, or fraudulent. If proven, misrepresentation can make the contract voidable, allowing the affected party to rescind or seek damages.
